Host Hub Hosting provides web hosting to many clients, and we have a
responsibility to protect each client and to provide the best services available.
The following guidelines were established to ensure these obligations are
met.
CONTENT:
All services provided by Host Hub Hosting may be used for lawful purposes
only. Transmission, storage, or presentation of any information, data or material
in violation of any United States Federal, State or City law is prohibited.
This includes, but is not limited to: copyrighted material, material we judge
to be threatening or obscene, or material protected by trade secret and other
statute. The subscriber agrees to indemnify and hold harmless the hosting
company and its employees from any claims resulting from the use of the service
which damages the subscriber or any other party. Pornography and sex-related
merchandising is prohibited on all hosting company servers. This includes
sites that may infer sexual content, or links to adult content elsewhere.
The hosting company will be the sole arbiter in determining violations of
this provision. Also prohibited are sites that promote any illegal activity
or present content that may be damaging to the servers or any other server
on the Internet. Links to such materials are also prohibited. We do not actively try to find sites or information on our servers
that are of an illegal nature (we would spend all of our time doing this),
we rely on others to let us know of any illegal activity. Any activity that
we do observe or made aware of will be reported to the proper officials.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites
Host Hub Hosting will be the sole arbiter as to what constitutes a violation
of this provision.
Unlimited Traffic:
We do not offer Unlimited Traffic. Other hosting companies do but require
you to keep within a certain guideline. We feel that by offering you a certain
amount of bandwidth, you have more freedom to build the site as
you want.
Server Resources
Any web site that uses a high amount of server resources (such as, but not limited to, CPU time, memory usage, and network resources over their allotted limits) will be given the option to either pay additional fees (which will depend on the resources required), reduce the resources used to an acceptable level, or upgrade its service.
Commercial Advertising - Email:
Spamming, or the sending of unsolicited email is STRICTLY prohibited.
Chat Rooms:
In general, we do not allow clients to install their own chat rooms. If
you want to install this, please ask us for permission as these tend to
be a large drain on system resources and we cannot allow it as an account
option. This statement does NOT apply to the provided Java chat room program.
Background Running Programs:
We may allow programs to run continually in the background. These are considered
on a case-by-case basis and an extra charge will be incurred based on system
resources used and operational maintenance needed.
IRC:
We currently do not allow IRC or IRC bots to be operated on our servers.
Server Abuse:
Any attempt to undermine or cause harm to a server, or customer, of the
hosting company is strictly prohibited.
Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
Multiple accounts/web sites within an account:
When we sell you a site, we sell it to you, not to you, your friends, family
or other businesses. If you add web pages to your domain (similar to geocities),
remember that the bandwidth that they use counts towards your monthly allotment.
Failure to meet the above regulations:
If you fail to meet the above conditions, you may still purchase a website,
however you will be required to stay within the bandwidth limitations for
that account as listed on the hosting page.
LIMITATION OF LIABILITY:
Host Hub Hosting shall not be responsible for any claimed damages, including
incidental and consequential damages, which may arise from company servers
going off-line or being unavailable for any reason whatsoever. Furthermore,
the hosting company shall not be responsible for any claimed damages, including
incidental or consequential damages, resulting from the corruption or deletion
of any web site from one of the company's servers. All damages shall be limited
to the immediate termination of service. Violations of these Acceptable Uses
Policies should be referred to support@HostHub.net. All complaints will
be investigated promptly. Failure to follow any term or condition will be
grounds for immediate account deactivation.
Money Back Guarantee:
Host Hub Hosting is pleased to offer a money-back guarantee should you
become unsatisfied within 30 days of your account activation. We do not refund
InterNIC registration fees.
99% uptime Guarantee:
The hosting company guarantees that your website will be up 99% of a given
month. Each month has 43200 minutes (60min x 24hours x 30days). We will calculate
downtime to the nearest minute or closest unit thereof. You will receive a
credit when your site is down, due to something on our side, for more than
432 minutes (7.2 hours). This is consective time and not cumulative (unless
we specify otherwise). Credits will not be given for user errors, IE: Changing
the DNS entries at Internic, accidently deleting your index.html page, ISP
problems, national fiber line cuts, etc. We will not be liable for any time
that a user requests us to work on their site, IE: changing an IP address,
reinstalling FP extensions, moving client to a different server, etc. We will
also not be liable for time where a user's site is suspended for non-payment.
The hosting company will not be liable for any lost revenues during your down
time.
DISCLAIMER:
The hosting company cannot be held liable for system downtime, crashes, or
data loss. We cannot be held liable for any predicted estimate of profits
in which a client would have gained if their site was functioning. Certain
services provided by us are not owned or controled by Host Hub Hosting. Thus, we cannot be held liable for things beyond our control.
ACCOUNT ACTIVATION:
By activating your account with the hosting company, you agree to the above
policies and disclaimer.
Modification
Host Hub Hosting reserves the right to add, delete, or modify any provision of its Terms of Use at any time with written notice 30 days in advance. It is your responsibility to monitor this page for any future changes.
